[This was in last week's issue. We're reprinting it because Mary's Boon's new owner, Raul Max-Brown, replied, and we want our readers to see what he is replying to. -Ed.]

 

I have been reading with great interest the goings on at Mary’s Boon as an owner. I too am outraged by the maintenance fee increase and the callous “pay it or lose it’’ attitude of the new owner, which presumably has the blessings of former owners Karla and Mark Cleveland who are still involved in Mary’s Boon, including owning residences there. After all, in their July 2007 letter announcing the sale they wrote, “We have chosen to sell to someone we truly believe will bring new perspectives, energy and most important, carry on the traditions that have made Mary’s Boon so great. The new owner is Raul Max Brown. He plans on operating the Hotel in much the same way as it has in the past.’’

 

As I read Raul Max Brown’s confusing and convoluted letter offering us options--conveniently mailed as the holidays and end of year are upon us and contract lawyers are hard to find--I wondered about his experience, something the Clevelands neglected to mention. Obviously it’s not in the communications or public relations fields. What is his business experience? What is his experience in the hospitality service industry? Does he have a string of successful businesses and the Clevelands are looking to him as The Great White Hope to turn Mary’s Boon around and make it the jewel of Sint Maarten? Or does he have a string of fly-by-night operations leaving a trail of debt and lawsuits in his wake?

 

I think the owners have a right to know a little more than the fact that he has “new perspectives and energy,’’ especially given the doublespeak, the outrageous fee increase, the inconsistencies, the poor way everything has been communicated, the timing and the fact that some [unknown party] answers a cell phone to Resort One, one of our so-called options. I think our reluctance is understandable. We pay him $1,000 a week this year and what’s to stop him from charging $2,000 a week next year or argue that a mid-year raise is needed because the price of lettuce might go up?

From Mary's Boon Beach Resort & Spa Owner Raul Max-Brown:

 

Dear Jeff, In reference to Michelle's letter, she states her concerns, I have put my contact info on all email, letters and your site, she can call and discuss her issues. She also mentioned that Mark and Karla sold it to me so I am the one that is going to save Marys Boon, acknowledges that there are changes that need to be made.

 

The previous two owners of Marys Boon were not previously in the Hotel business prior to owning the hotel. I have 20 years Advertising, Marketing, Retail and PR experience (working with Bar, Restaurants, Salons, Automotive, and Hotels). Again if Michelle is not clear on the letter she should call me or the other contact person on the letter, like many other owners have done and got clarification on her concerns.

 

As for the [online complaint Jeff mentioned that was shown at http://www.ripoffreport.com/reports/0/200/ripoff0200243.htm ], that's from a former independent contractor that was let go. He post lies on this website. This website post whatever they want without facts, I responded and showed them proof, they can't get a hold of the person. His claims are impossible, ALL sales reps were independent consultants (1099, no taxes ever taken out by company), also we don't bill or charge our customers anything, the company strictly made money from the selling of the promotions that we did for them. If you or anyone has questions on how that works call me I will explain.

 

Michelle also states that I mailed it at a bad time, invoices in the past went out mid to end of November, and dues Jan, 1. I mailed it 1st week in Dec, Dues Jan, 15th. and have worked things out with many owners.

 

These people need to understand that Marys Boon timeshare was not a successfully organized program, 155 weeks of 1850 sold by 4 (that I know of) different companies, there are currently about 135. They need to acknowledge that it costs a lot more to run ANY business than it did 5 years ago, also the property was extremely underinsured, if something had happened you would have a Mullet Bay situation. I have tripled the coverages (hurricane, earthquake, floods). It now costs almost $70,000/yr to insure the property.

Jeff Comments: One restaurant owner told us 12 years ago that his hurricane insurance alone at that time was about $30,000, so Mr. Max-Brown's figure of $70,000 is quite plausible. -Ed.

From Mary's Boon Timeshare Owner Tim Adair:

 

We are also owners at Mary's Boon. When we bought our timeshare, Mark and Carla Cleveland told us we were now part of a family. I now find that the $10,000.00 we paid for a timeshare is worthless.

 

On top of it, I remember when the big storm wiped them out; they asked for and we paid them an extra $600.00 to help out with the repairs. It seems that under St. Maarten law we have no recourse. From looking at ours and others' problems with timeshares on this island, I would strongly urge anyone contemplating timeshare or other purchase on this island to look at other islands….

From Mary's Boon Timeshare Owner Beverly:

 

"…My maintenance on 2 beachfront units began at $350..then was raised to $375..and last January it was raised to $400. which might have been fine, except for the fact that the bedspreads were the same torn, tattered ones with the exact same cigarette burns year after year...and the sheets and towels were also torn and like sandpaper.

 

In other words...NO work was done on those units in the 7 years I was a timeshare owner and still no work has been done on them.

 

[Mr. Max-Brown] also has not answered my accusation that you printed that the maintenance fee is now the exact price it cost last May to rent out the unit for a week, thereby rendering the timeshare ownership valueless.

 

He also has not responded to [other] issues, such as prohibiting sale or transfer of ownership and prohibiting 'in-house banking' of our weeks.

 

He has unilaterally changed the terms of all the sales contracts, without anyone agreeing to the changes. He just keeps talking about the Tides restaurant like any of us care about that.

 

[I wonder] who exactly owns Mary's Boon, and would they provide us with proof of such ownership?

From Mary's Boon Timeshare Owners Kim and Preston McKeon:

 

I only came upon your site today, finally doing a Google search on Raul Max Brown myself.

 

My husband and I have been timeshare owners at Mary's Boon for the past 10 years. We visited the Boon recently in November, only hearing about "the letter" and doubling maintenance fees from other guests. Later, we received our letter from Mr. Brown in December 2007. We are now frustrated by the lack of information coming our way ever since. Isolated as we are up here in the snowy north, I hope you are able to connect us with other owners in our predicament.

 

We did sit down with Mr. Brown to hear his ideas during our recent visit. He certainly seems to be personable. Yet his communications and processes in this business transactions are less than straightforward or informative. (We worry that this is either intentional or due to lack of business sense.)

 

Earlier in December, my husband did contact Sky, the designated representative found in Mr. Brown's letter; we have yet to hear back from him with any information. He did tell my husband that only a few condos have been sold. We'd expect to be getting more of a sales pitch, as we did nibble at the hook....

 

As others have mentioned, we had trouble getting access to any Resort One website. I used the website referenced in Mr. Brown's letter, which only allowed viewing of a Flash presentation. However, using the website mentioned earlier (as referenced at your site), I was able to sample the site using Mary's Boon ID and password (given in Mr. Brown's letter). I am a bit reassured that this is a legitimate vacation club, but would like more information, especially to raise questions re: hidden costs to us over the upcoming years.

 

My son is just beginning his own marketing and business degree in college. He too can see the red flags in this whole story, warning me, "Even nice guys [could] cheat you out of your money." We question the step to raise maintenance fees more than 100% well before any renovations to individual units have happened. Changes have occurred on the property, but I would label most of these "necessary updates", not major renovations. Rising electric and water costs alone don't add 100% to maintenance, which leaves us only to conclude that we timeshare owners will be footing the bill for these renovations.

 

Perhaps that does add up to good business sense in Mr. Brown's eyes, but we don't need to participate in that type of greed. The Boon is a great property that can be a business success without stooping to such extremes -- if that is really what's going on in the business office.

 

My husband and I would definitely like to connect with other owners and hear of their experience… We have loved our time in St. Maarten, but now we feel shark-bit. Knowing that we are unlikely to come out anywhere near even with Mary's Boon and Mr. Brown, we will probably keep our travels within the US borders. This saddens me…

 

 

 

========Diamond Sunterra Royal Palm Beach Resort========

From Royal Palm Timeshare Owner Michael Duda:

 

I am looking at my Royal Palm Beach maintenance bill for 2008, for a 2 bedroom the total is $888.25. A $50 increase in "Replacement Reserve" to $180.25 and a 15% increase in Maintenance to $708.00. I received it 2 days before I went to Sint Maarten this year. We were on the island from Dec 6th to the 17th.

 

I went to the "Update" to listen to what Diamond International was going to do for the owners. It was just a buy points deal, no real update, except the rep kept saying the owner is spending $1.1 billion on upgrades to the whole company. With the $142.25 just from me in 2008, one does not have to wonder where the money is coming from.

 

Traffic, those going in the next few months, GOOD LUCK, the drawbridge is causing problems one way and the airport parking lot the other way. Avoid the airport between 2:00 pm and 5:00. Avoid the drawbridge when it is scheduled to open. The Mega Yachts are great to look at but, just two going in or out of the lagoon causes mega back ups. Read the Daily Herald "Letters to the Editor".

 

There is a greater police presence on both sides of the island, yet the biggest robbery $850,000 happened at the airport.

From Diamond Sunterra Timeshare Owner Bruce Cameron:

 

I like you consistently advise folks to read their contracts when they are trying to deal with maintenance fee issues.

 

As many people know, the Vlietman related resorts of Pelican, Flamingo, Royal Palm and Atrium had a bewildering array of contract terms. Even the basic terms changed year to year.

 

With respect to the now Sunterra/Diamond-owned resorts of Royal Palm and Flamingo, none of the contacts written by Sunterra have any guarantees about fees. Some of the very early contacts by Vlietman had caps until a certain date that has long since passed. I have yet to hear from a regular owner at Royal Palm or Flamingo who has a contract that limits increases at the present time. (The Royal Palm ”whole share" owners are in a whole different world) If anyone on your list has a contract at Royal Palm or Flamingo that currently limits fee increases I would be very glad to talk to them.

 

Final note on points fees at Flamingo/Royal Palm. The issue is fairly moot as the points owners now have first rights on all USA resorts not just the St. Maarten ones and so the original St. Maarten Sunterra points owners are now competing with the entire USA pool of points owners for occupancy in St. Maarten (unless they have a specific contract right to have first dibs on their original units...) So they pay the average cost of maintenance at all the Sunterra/Diamond resorts in the USA and Caribbean.

 

The real cost of the maintenance at Royal Palm and Flamingo is paid by the actual owners - the fixed week owners or the Sunterra/Diamond Trust. ========Wyndham Sapphire Beach Resort========

From Wyndham Sapphire Timeshare Owners Gloria Darin and Betty Nolan

 

Just wanted to give you our impression of our recent visit to the Sapphire Beach Resort 12/8-12/20). We arrived 12/8 with our friends and checked into our Villa #13. Upon arrival they were asked to also "check in" via their credit card. I thought it was strange since they were staying with us at the Villa. They were given their own set of 'keys' to the unit.

 

Villa 13 (12/8-12/15):

The safe was locked upon arrival. It was fixed the next day. The AC unit in Main area leaked and left a huge puddle. Repaired within 1 hour of our call. No other maintenance problems at the Villa.

 

New non-slip tiles were replaced around the plunge pool. Newly painted rooms. 19" TVs in each room (standard not flat screen); they did look new. VCRs in each room (2 bedrooms/1 main area). New cushions on old furniture. Same old curtains on sliding doors. Lampshades need to be replaced on ALL lamps (old and torn). Bedspreads-same old ones. Mattress-comfortable but same old one. Maintenance did come in on our last day to check to see if everything was working OK (fridge, microwave, stove, dishwasher). No ants (noticed ant traps in kitchen cabinets). More than enough glasses, dishes, etc.

 

The transfer to our 2nd week went smooth. We dropped our friends off at the airport and settled in to our new unit. The beginning of each of our weeks we were 'delivered' a letter requesting that we pay our Supplemental Fees. We ignored them and never had a problem.

 

Unit 361 (12/15-12/20):

New paint in rooms. New cushions on same old furniture. Sofabed had same old blue cushions that did NOT match newer cushions. 19" TVs (1 bedroom/1 main area) reception on one was terrible. VCR in bedroom only. Ceilings had numerous cracks. Bedspreads-same old ones. Lampshades need to be replaced on ALL lamps (old and torn). Mattress-terrible, same one from day built. Same old curtains on sliding door. Jacuzzi was clean and operational.

 

Overall Appearance/Observation:

 

Lobby furniture is new but not comfortable at all. Doesn't fit in with the Caribbean flair.

Facade needs a good paint job/cleaning. Lounge chairs around pool are hard PVC and uncomfortable. The few 'strap' chaises were taken quickly. Umbrellas were scarce and most inoperable. Bar area is old and worn looking. They no longer allow you to put the tab on your room. Pool and whirlpool were clean. Grounds were green and lush. Beach area-some to none. Personnel-friendly and pleasant (especially the maids).

 

Traffic around the island is horrendous. Buildings going up all over....that's all you see now.

 

Let's hope the litigation works in our favor….

In regard to Kevin Green's request about info on selling of Sapphire Timeshare. You won't believe this one... my sister owned a one bedroom, Sapphire said they could sell it, after all fees (including assessment) she received a foreign check for $210. in Sept. and she still has not been able to use the money as the bank won't clear the check. I don't think selling through Sapphire will get you anything but a headache.

Jeff Comments: Dutch Side checks are very difficult to cash in the USA no matter what size bank you use. Ask them to wire the money to your bank instead, but then you'll likely have to swallow bank fees too. You're better off selling them on our site since we charge no fees or commissions. Lead Story: Update on Crime in St. Maarten

It hasn't been a good week for law-abiding tourists on St. Maarten.

The good news is that there have been no "major" crimes like sexual assaults or murders (there rarely are, fortunately) but the bad news is that the frequency of "lesser" crimes seems to be increasing, based on anecdotal evidence. And those crimes are only "lesser" if you aren't the victim.

Criminals seem to be getting more brazen, as well, sometimes doing their thing in broad daylight as we told you last week. The story last week regarded Maryann B from Virginia, whose bag was looted in plain sight of others before noon on Mullet Bay beach.

Press reports in the last week cited a holdup of golfers on the Mullet Bay golf course, a late evening holdup in front of a hotel in downtown Philipsburg, and a late-evening holdup on Cannegieter Street in Philipsburg, parallel to the pondfill.

Anecdotal evidence seems to indicate that crime increases to a high point each fall, when the fewest tourists are around; this year, the apparent increase seems early.

Tragically, not all crimes in St. Maarten are minor. More than a year ago, two gay men were savagely attacked by homophobes near Sunset Beach Bar after hugging inside Bamboo Bernie's; one was lucky to survive.

And just about one year ago, Angelique Chauvire, who had worked at the Sexy Fruits store on Orient Beach and was well known to island visitors, was murdered in the hills near Dawn Beach. Flipper Dolphin, the pseudonym of the person who does

As is the case at home, keep your wits about you when you are in "paradise." Stay out of dark areas or unfamiliar places. Don't leave valuables in your car or car trunk, only in locked room safes. Crime is not rampant in SXM like it is in Trinidad, Jamaica, or the D. R. (where you check into resorts and stay there for your entire trip). But it is paradise and NOT utopia: crime exists in SXM just as it does in your town. Be cautious and watchful as you would at home and you should be fine.

Feature Story: Internet Scam Warning

When you are selling or renting out your own timeshare on the Internet, NEVER accept any sale, rental, or exchange offer from anyone who sends you a cashier's check or money order or any other negotiable instrument for an amount in excess of what you're charging, then demands you pay them the difference in a hurry. There are Internet scam artists who make a living by presenting stolen or counterfeit checks and getting real cash refunds from you for their "overpayments." Don't be a victim. The FBI is investigating these incidents.

N. B.: Never assume that "collected cash" in your bank account means a check is actually good; sometimes it takes two weeks for banks to realize checks are bogus, and by then it's too late to help you if you've refunded any "difference."

Again: NEVER accept any payment in excess of your price from anyone, for any reason, and never, ever refund any "overpayment." If you know anyone else who ever advertises any vacation property anywhere for rent or sale, send this entire newsletter to them and point out this article. It could well save them thousands of dollars.

1. Questions and Answers About Current / Future Airfares to St. Maarten

We routinely receive many emails about airfares to SXM. Here are a few recent questions that we thought would interest many members:

Q. We've been following Spirit Airlines the last few weeks and notice there have been no sales to St. Maarten when they post other sales. What gives?

A. Airlines post sales when they need to sell seats. We've kept meticulous records the last few years and there's a definite pattern to when they do this, though variations occur. Spirit has only been serving SXM for five or six weeks so they have no "pattern," but they have little capacity (flying three times a week on A319 aircraft). They will likely grow their frequency to daily late this year. More sales are likely then, particularly if they add more flights on Friday, Saturday, and Sunday. Members needn't dote on watching them since we do, and we always try to report all relevant sales as quickly as we can.

Q. How do round-trip air prices look for next winter?

A. We expected little airfare action in May because of spiking jet fuel prices. As members know, prices for travel now through next April came in way under what we expected, and we notified members several times in May about $300-range round trips from the Northeast, Southeast, Midwest, and Southwest. June may be slower; usually it is the second slowest month of the year for travel to SXM and many folks are preoccupied with other things in June. Nonetheless, we are watching fares from wholesalers, consolidators, charter operators, and the airlines themselves around the clock and will holler at once whenever we uncover significant changes. Fares for next winter have "dipped" to lower-than-usual numbers several times in the last few months, surprisingly. When you get an Airfare Bulletin, jump quickly if it shows fares you want; they are available but they sell quickly.

Q. If I can get some of these fares directly from the airline, why should I pay you?

A. We are on the phone and on the net searching for breaking fare news 24/7/365. Minor changes are virtually always posted immediately on our "secret site" Current Airfare Sales page, but major changes (reflecting hundreds of dollars off "traditional" fares) get noted both online and via an immediate Low Airfare Bulletin to all members.

Contrary to what you might think, airlines almost never ballyhoo the vast majority of their significant fare reductions; it's peculiar but true. And air travel websites won't tell you when fares to foreign countries (SXM) decline; only we do that. Yes you can get some of these fares from the airlines, but the trick is knowing precisely when they're available. Airlines communicate a tiny percentage of fare reductions. We communicate as many as we can get our hands on, and that is hundreds of them. You can't save on airfares unless you know when they've dropped, and that's where we come in. Unless you want to spend your life searching, the chances are small that you'll find these fares. It's why close to 4800 people have joined us since JMB Website Supporters began in 2002.

Q. I haven't seen many low fares from the west coast lately. Why?

A. We have many members in Southern California and the Pacific Northwest looking for low fares. During the last six to eight months, we've seen fewer low fares from that area than in the past. It hasn't gone on long enough to be a "trend" but it is annoying to us as well as to you, since we can't create fares --- only report them. We are actively searching for fares from throughout the US, Canada, and Western Europe and we have every reason to believe sale pricing will return to the West Coast and Pacific Northwest, particularly as competition heats up.

Q. What's up with Jet Blue?

A. Good question. We heard from three sources nearly a year ago that they were coming to SXM in "Winter 2007" but it never happened. In summer 2006, they pushed out / slowed some expansion plans and we suspect that's what they did with SXM. We still expect them to add routes to SXM, starting with JFK. It would not surprise us to see them also fly to SXM seasonally from BOS and CLT, but who knows? We've heard nothing for a year. The head of another big airline in SXM told us last winter, "They'd be fools not to come in here," and we totally agree.

Q. I've read all the complaints about US Airways. They are convenient for me. Should I really stop flying them?

A. If you like an airline and have confidence in them, stay where you are. US Airways (and American, and Delta) all have problems to overcome and they will. US Airways is keenly aware of its deteriorating service and its disappearing passenger base and it intends to solve its problems. American's pilots and other employees are livid over that airline's big payments to management, so they (despite much higher customer satisfaction than US Airways) are no more stable than US Airways. Delta has just limped out of bankruptcy and hasn't clearly shown what it wants to be when it grows up. Other airlines may simply be different, not "better" in terms of stability. On the other hand, we haven't flown US Airways in years; we fly mostly AA and Jet Blue.

2. Reconfirm Your Flight Reservations

US Airways, Continental, United Air Lines, American, and Delta all have made schedule changes in the last several weeks that have affected thousands of reservations.

If you have confirmed seats on future flights to SXM on any of these airlines, call your airline now to reconfirm and call again a couple of weeks before you're scheduled to fly. The airlines might have some schedule surprises for you and they (for whatever reason) don't seem highly motivated to call to tell you. Please call them.

3. AA Honchos Looking Like Something Other Than Geniuses

We're keeping an eye on news from pilots and other employees at American, who are not at all happy about big bonuses that airline is offering senior execs while giving pilots and others "bupkis." The pilots and employees agreed to hundreds of millions of dollars in wage and benefit concessions to avoid bankruptcy, and now this happens. Despite their unhappiness, they are performing professionally. Hopefully the airline will take care of them but if it doesn't, they certainly have the capacity to take care of business themselves.

We'll keep watching this.

4. SXM To Ready Port For Megaships Carrying 4500+ Passengers

The Wathey Cruise and Cargo Facility at Point Blanche is apparently going to get a multi-million-dollar upgrade to help it keep pace with the next class of superships which, we think, Royal Caribbean should rename from "Genesis" to "Humongoid Gargantua."

The current largest ship in the world, RC's Liberty of the Seas, was slated to visit SXM last Tuesday, but it is a rowboat compared to Genesis ships. Liberty, according to press reports, has a gross tonnage of 160,000 and can accommodate 3,630 cruise passengers and
a crew of 1,360.

Big deal. Cruise Critic notes, "Royal Caribbean has announced it will build cruising's biggest ship ever with the development of a 220,000-ton, 5,400-passenger ship. To be developed under the project name Genesis, the first ship is planned for delivery in fall of 2009."

With major port changes, SXM will be ready to accommodate the Humongoid Gargantua class of ships in 2009.

It started last Friday and on Thursday, NOAA and the National Hurricane Center issued a "Special Weather Statement" about a system near the Yucatan that it felt had some potential for development. That storm turned into T. S. Barry, the remnants of which were soaking New England this morning.

7. Big Sign At Pelican Adds Insult To Injury to C, D Building Owners

As if erecting a humongous monolith (the "Marina Residences") in front of the verandas of C and D building timeshare owners weren't bad enough, we hear now that Pelican Resort Club / Royal Resorts has plastered a three-story by 10-foot wide billboard on the side of the Marina building exhorting, "Want this View?"

The billboard then shows a picture of the Simpson Bay view that was available to all C & D building owners until Pelican/Royal decided to obliterate it by piling about 9 or 10 stories of "Marina Residences" there. Perhaps the sign should read, "For only $85,000, we'll give you back the view you thought you bought from us before."

And will they refund the original cost paid by timeshare owners of the C & D buildings? Sure, when the island has its first blizzard.

All of which forever redefines "bad taste," doesn't it?

11. Caravanserai Update

Although construction of the new units at Caravanserai Resort, Dutch Side, was approved months ago, we've seen nothing further about it. Some minimal site preparation was underway late last winter, but we've seen no news about when this long-delayed project will actually be done. Neither is there info about when the long-dormant Casino on the property (formerly Dolphin, which moved to Simpson Bay) will reopen.

As soon as we hear more we'll pass it along.

12. Sun Resorts, Mullet Bay Beach Resort Owner, Is Sold: Marina Development Likely

The good news: Orient Express' new development at the Northern end of Simpson Bay Lagoon may well become the best looking resort on the island. It includes a yacht club.

The bad news: The more yachts and megayachts that are stuffed into Simpson Bay Lagoon, the more demand there is for the Dutch Side drawbridge to open, snarling traffic.

Now, Sun Resorts, owner of Simpson Bay Yacht Club and the remains of the old Mullet Bay Beach Resort, has been sold and you'll be surprised to know that the buyer is an experienced developer of marinas.

The Caribbean facilities are: American Yacht Harbor, St. Thomas, USVI; Simpson Bay Yacht Club, St. Maarten, NA; Virgin Gorda Yacht Harbor, Virgin Gorda, BVI; and Village Cay Marina, Tortola, BVI. As a part of the transaction, IGY acquired American Yacht Harbor in St. Thomas outright and all of SRI's interest in the three other Caribbean facilities. The Sun Resorts acquisition adds 442 more berths to IGY's Caribbean offerings alone."

IGY's plans for SXM are not known, but will likely involve further marina development either at Simpson Bay Yacht Club or Mullet Bay Beach Resort, or both. We'll keep you posted.

13. Turtle Pier Back on 'Recommended' List

Simpson Bay landmark Turtle Pier Restaurant, under a new management team for almost two years, ran into some administrative problems when it was converting from old to new management styles. The dining room staff was replaced and while changes were being made, service suffered.

The good news is that, according to members who have been to Turtle since February, things are now back to normal -- good service and delicious food.

That's welcome news since TP, still owned by Al and Rose Wathey, is a kick. Great full American breakfasts, lots of choices for lunch, and fine seafood and steaks for dinner and of course, their legendary lobsters from their own lobster pond in Simpson Bay Lagoon. (Don't forget their coconut shrimp.) We'll be expanding our coverage of them on everythingstmaarten.com soon... do check them out. They are next to Avis on Airport Road, Dutch Side.
