Lead Story #1: On The Crime Situation in St. Maarten

Crime is a fact of life in most countries, and St. Maarten is no exception. We’ve often quoted Kathy Hetzel who said SXM is paradise, not Utopia.

 

Marechausses are the Dutch equivalent of military police, and some have been brought to the Dutch Side to help the severely understaffed police department there do its job.

 

The police and politicians aren’t helping their own cause, however. They complain of inadequate staff year after year but don’t give the problem true priority and they don’t solve it.

 

SXM is not Jamaica or Trinidad or the D. R., where people go to fortress-type resorts and don’t leave until their flight home. Far from it, fortunately.

 

But in the last few weeks, four lesser-known Philipsburg jewelry stores have been held up in broad daylight and last week, during the most recent holdup, it took Dutch Side police more than 40 minutes to respond. The police station is three blocks away. Skipping their way from the police station, some offers could and should have made it in under 10 minutes. They also reportedly complain that whenever they are called upon to do something, they must turn their attention away from doing something else.

 

But their job is crime fighting. The government talked about forming a “Soualiga Patrol” (tourist police) at least three years ago, but it has never come remotely close to living up to its advance billing.

 

We regard St. Maarten as a safe island, far safer than those noted above. But not accepting FBI offers of help in the now nearly three-month old disappearance of American Leta Lynn Cordes, not responding to a brazen daylight robbery in Philipsburg until more than 40 minutes after it happened, and numerous other non-responses to crime give the impression that SXM is soft on crime, if it cares about it at all.

 

We know that’s a wrong impression. But the island needs to get on this with a real sense of urgency before too many tourists decide the traffic jams, the over-development without attention to infrastructure, and the crime aren’t what they want in a vacation. The island so far has no massive numbers of tourists turning their backs on it. But some tourists are not coming back, and the island needs to act if it’s to keep the golden-egg-laying goose of tourism healthy and productive.

1. AA, Delta Cancel Hundreds of Flights

 

Both American Airlines and Delta cancelled hundreds of flights last week including some that fed passengers to their St. Maarten gateway cities. Older MD80 aircraft were involved in a hastily ordered FAA inspection of wiring harness bundles.

 

Service is expected to return to normal this week. SXM flights from the US don’t use MD80s and were not directly affected.

2. AA May Charge $25 For Second Bags

 

At a turkey farm, if one turkey gobbles, they all start gobbling.

 

We’re really not equating airlines with turkeys, but they do all have a flock-like mentality. Now AA, the biggest carrier to SXM, says it is looking into charging $25 for checking a second bag per person.

 

They’ll do it. Although they’re getting hammered by jet fuel price increases, their own fare and fee increases domestically have more than offset those increases, from what we’ve heard.

 

In any case, more fees are coming soon. Isn’t that nice?

3. Regardless of Fees, Bags Still Get Lost

4. A Great Source of Travel Info Regardless of Where You Fly…

 

David Rowell started writing “The Travel Insider” not long after 9/11, in those days when each of us started to wonder about the safety of our next flight. His website www.thetravelinsider.com is a great source of air travel info as is his periodic email newsletter. If you do much air travel anywhere, it’s well worth your time.

5. SXM Sonestas Offer Two Days Free

 

The only chain hotel with a double presence in SXM is the Sonesta hospitality group, with the Sonesta Maho Beach on the Dutch Side near the airport and the Sonesta Great Bay Beach at the western end of Great Bay Beach in Philipsburg. (Both like to sell you plans including meals which we never recommend because SXM boasts so many extraordinary restaurants…in all price ranges.)

6. All SXM Timeshare Resorts To Be Affected by Festiva Court Ruling

 

Courts in SXM are apparently about to rule on Festiva Atrium’s attempt to rewrite existing contracts with timeshare owners.

 

If the court agrees, the resort will be able to levy Special Assessments and much higher Annual Maintenance Fees than its current signed contracts with timeshare owners allow.

 

Atrium owners are furious. “These are signed contracts,” one told us by phone, “and they just want the court to say, ‘It’s ok, ignore them, charge what you want.’ It makes no sense.”

 

Timeshare owners at other resorts should watch this closely because if Festiva prevails in court, it’s reasonable to conclude that any other timeshare resort that wanted to rewrite its existing contracts with timeshare owners could do so at its discretion and the government wouldn’t intervene.

 

It appears to be the single most anti-consumer move we have ever seen in St. Maarten. 7. ZuZu Offers Grand Case Apartments

 

ZuZu, the lovely former owner of Le California, last week updated us on what she’s up to.

8. Huge “Everything St. Maarten” (ESM) Website Update & Overhaul Underway

 

The first step in a major update to our “ESM” website occurred late last week when we reduced the content on our home page by 2/3, greatly simplifying the ability of travelers to find what they want quickly.

 

“When our current site was conceived in 2006, our biggest challenge was organizing what at that time was 90 pages of website,” said Jeff Berger, founder and CEO of “ESM” parent JMB Communications. The development team chose to organize the site into four logical sections, “First Things First,” “Before You Fly Down,” “When You First Arrive,” and “While You’re Here.”

 

Berger hated it. “It isn’t fast enough,” he said, but at the time he went along. Those sections still exist, but now “we moved direct links to what people really want up near the top of the page,” Berger says. Restaurant, beach, shopping, and other highly sought material is much easier to access now.

 

The site also has its own Google search engine, which can help visitors find anything the site offers --- now 136 pages of info. By the end of the year the site will likely be over 200 pages. The objective is ultimately to make the site true to its name, ‘everything’ St. Maarten and St. Martin, Berger noted.

 

He also noted that Website Supporter member benefits are being expanded significantly this year. “We’re adding more discounts, which members asked for,” he said. “We asked a small randomly picked focus group what they wanted, and we expect to deliver on many of their requests over the next few months. Stay tuned.”

9. Peg Leg Pub and Steakhouse Relocating to Port de Plaisance

 

Linda and Jack Parker will soon be moving Peg Leg Pub and Steakhouse to Port de Plaisance on the Union road from their current Three Palms Plaza location in Simpson Bay.

 

“We will be moving to Port de Plaisance by Princess Casino,” Linda tells us. “I don't have an exact date… early in April, though. The menu will be similar, but a bit more continental. We will be adding things like Beef Carpaccio, sashimi, and a few other appetizers. We are still discussing things at this point.”

 

In addition to an expanded menu, the new location offers much better parking and more opportunities for innovation, which marks all fine restaurants. Peg Leg Pub and Steakhouse has long been known as one of the island’s top destinations for fine steaks and seafood, but now they’ll be able to offer a wider spectrum of selections people have been asking for.

10. Be Wary of Pic Paradis . . . Again

 

One of the most scenic of all locations on the island is Pic Paradis on the French Side, above Loterie Farm.

 

In the past, we’ve warned readers about car break-ins there, but those reports diminished over the last couple of years --- until now. Reader Judy Murdoch writes:

 

“I read your Bulletins faithfully before we ventured to St. Martin and found them very helpful. One thing that does need updating, though, is under “Safety” and Pic Paradise. We were in St. Martin in December and went to Pic Paradise. We were literally not gone from our car 5 minutes and our car was broken into. And, because we had activated the ‘valet lock’ on our trunk, (by turning the trunk lock ¼ turn it deactivates the trunk release) they chose to rip the back seat out when they couldn’t use the trunk release. Afterwards, we could hear them talking etc. down the hill in the woods. We got out of there quickly because we felt very unsafe knowing they were just a few feet away and likely still watching us.

 

“When we reported this to the Police they told us we were the third reported break in at Pic Paradise that day. I would not recommend that people go there. I don’t think it is safe. There are plenty of other great views without seeing this one.”

 

There are plenty of gendarmes on the French Side. You see them riding around the island in minivans, often six to a minivan. The do sobriety checks, they patrol Orient Beach, and they ride around. We have seldom seen them on foot in Marigot or Grand Case and never at Pic Paradis (Paradise Peak).

 

Do they need to be told where crime is happening? When I was a police reporter many years ago in Providence, R. I., police actively patrolled the entire city and had tactical teams focus on areas needing it. In St. Martin, gendarmes ride around together in minivans or walk the beach, and Lord knows what police do on the Dutch Side --- though we have seen some very effective undercover work there (and they are still severely understaffed). But it still strikes us that far more could be done, on both sides of the island.

 

Ask the family of Leta Lynn Cordes, the Californian who has been missing on SXM (from near her Dawn Beach home) since January 12….

12. Dutch Side Declares Moratorium on Car Rental Company Licenses

 

On our current SXM trip, we’ve spent a lot of time car-watching and found more local cars (M and P plates) than ever. Even in early January, traffic jams occurred without many “R” (rental) cars on the road.

 

Now the Dutch Side has decided to combat traffic jams by declaring a moratorium on new licenses for car rental companies. (Note: Some already-issued licenses for companies not yet on the road will still mean more car rentals are coming.)

 

Unfortunately, it won’t make much difference. The Dutch Side allowed runaway development without supporting infrastructure. What it needs is infrastructure, such as a bridge over the lagoon so people can avoid the Simpson Bay drawbridge traffic. Until that happens, changing the draperies (car rental license moratorium) won’t make much difference. Our sense is they know this full well and the license shtick is just politics; we expect them to act on traffic seriously in the next year or two. The problem is too serious for planning not to be well underway.

13. Theo Heyliger Best Wishes

 

Former Dutch Side tourism commissioner Theo Heyliger, who recently took over public works as his portfolio, has been recovering from serious surgery he had recently. We wish him a speedy recovery.

 

Heyliger, who was heavily involved in the Cruise and Cargo facilities (now being enlarged for the next class of mega ships), the airport, and the beautification of Front and Back Streets, will play a major role in any lagoon bridge or tunnel project that comes to fruition. If we understand it correctly, he is one of few Executive Council members who focuses almost entirely on his government role and has no other major time-consuming outside interests. We’d guess that’s why he gets the juiciest portfolios and runs with them, which is why we’re optimistic about the island solving its traffic problems with him in charge of public works….

14. La Gondola Schedules Annual Closing; Updated Menu Coming

 

Davide Foini, Marco Ferrante, and the staff at La Gondola write:

 

“I hope everything is fine, everybody is talking about vacations but they look so far still.....

as usual our last day open will be Saturday May 31 and we will be open back on Monday July 14. We will finish the season with the old menu and when we open back we start with the new one.”

 

During the winter, La Gondola --- which to us is St. Maarten’s best restaurant --- quietly served as “specials” a number of dishes it plans to introduce to its legendary culinary repertoire. Your favorites will remain, of course, but the best of the best of these specials will be coming onto the new menu. They’ll be posted on www.lagondola-sxm.com before the restaurant’s July reopening.

15. "Everybody Has a Station" Winner Announced

 

We all have a role in life. In parking lots all along the East Coast of the United States, seagulls perch atop high-pressure sodium lighting fixtures as if they were assigned.

 

One pelican seems particularly interested in taking up an early-morning position atop the drawbridge on the Dutch Side -- we saw him (her?) preening there every morning for about a week and a half.

 

We conducted a naming contest for this bird and the winner is attorney N. Wallace Kellerman of the Atlanta area. She writes:

 

“If one travels rivers in the US of A and one wants to know the history of a river, one asks a Riverlorian, (a teller of tales) .. after learning this, I started a newsletter in our subdivision about 12 years ago called the Riverlorian because you got it .. we live next to a river ... and a newsletter ...well you know what I mean.

 

“I think our precious pelican could be called either a bay, bridge or ocean lorian because it is definitely the silent keeper of the tales of SXM especially as it watches over all who pass through our beloved drawbridge...in a month it may well find a new perch but it will be near water, that is for sure.”

17. How To Have Friends, Family, and Business Associates Call You in SXM

 

There are two sides to getting good rates for phone service regarding St. Maarten.. the first involves your own phone calls on and from the island when vacationing there. The second involves how much your friends, family, and business associates must pay when they call you on the island. Their expenses, depending on their long-distance carrier, can be substantial, but you can help.

 

We have long recommended Sharon Harris as a source for inexpensive local and long-distance calls originating in St. Maarten. Sharon's cell phone rentals are in a storefront at Royal Palm Beach resort. You can also reserve a phone, which we strongly recommend you do well in advance, at her website, www.queenofsxm.com .

 

If something is going on back home and you need friends, family, or business associates to call you, consider having them make those calls on your dime:

 

Go to www.phoneanywherecheap.com and set up an account there, and your friends and family and business associates will be able to call the island for pennies, literally. The service uses AT&T lines but at wholesale rates which are almost invariably far less than most people pay on their regular services. The rates are generally between 9 and 13 cents a minute, depending on which side of the island you're calling and whether you're calling land lines or cell phones. Lead Story: Update on Crime in St. Maarten

It hasn't been a good week for law-abiding tourists on St. Maarten.

The good news is that there have been no "major" crimes like sexual assaults or murders (there rarely are, fortunately) but the bad news is that the frequency of "lesser" crimes seems to be increasing, based on anecdotal evidence. And those crimes are only "lesser" if you aren't the victim.

Criminals seem to be getting more brazen, as well, sometimes doing their thing in broad daylight as we told you last week. The story last week regarded Maryann B from Virginia, whose bag was looted in plain sight of others before noon on Mullet Bay beach.

Press reports in the last week cited a holdup of golfers on the Mullet Bay golf course, a late evening holdup in front of a hotel in downtown Philipsburg, and a late-evening holdup on Cannegieter Street in Philipsburg, parallel to the pondfill.

Anecdotal evidence seems to indicate that crime increases to a high point each fall, when the fewest tourists are around; this year, the apparent increase seems early.

Tragically, not all crimes in St. Maarten are minor. More than a year ago, two gay men were savagely attacked by homophobes near Sunset Beach Bar after hugging inside Bamboo Bernie's; one was lucky to survive.

And just about one year ago, Angelique Chauvire, who had worked at the Sexy Fruits store on Orient Beach and was well known to island visitors, was murdered in the hills near Dawn Beach. Flipper Dolphin, the pseudonym of the person who does

As is the case at home, keep your wits about you when you are in "paradise." Stay out of dark areas or unfamiliar places. Don't leave valuables in your car or car trunk, only in locked room safes. Crime is not rampant in SXM like it is in Trinidad, Jamaica, or the D. R. (where you check into resorts and stay there for your entire trip). But it is paradise and NOT utopia: crime exists in SXM just as it does in your town. Be cautious and watchful as you would at home and you should be fine.

Feature Story: Internet Scam Warning

When you are selling or renting out your own timeshare on the Internet, NEVER accept any sale, rental, or exchange offer from anyone who sends you a cashier's check or money order or any other negotiable instrument for an amount in excess of what you're charging, then demands you pay them the difference in a hurry. There are Internet scam artists who make a living by presenting stolen or counterfeit checks and getting real cash refunds from you for their "overpayments." Don't be a victim. The FBI is investigating these incidents.

N. B.: Never assume that "collected cash" in your bank account means a check is actually good; sometimes it takes two weeks for banks to realize checks are bogus, and by then it's too late to help you if you've refunded any "difference."

Again: NEVER accept any payment in excess of your price from anyone, for any reason, and never, ever refund any "overpayment." If you know anyone else who ever advertises any vacation property anywhere for rent or sale, send this entire newsletter to them and point out this article. It could well save them thousands of dollars.

1. Questions and Answers About Current / Future Airfares to St. Maarten

We routinely receive many emails about airfares to SXM. Here are a few recent questions that we thought would interest many members:

Q. We've been following Spirit Airlines the last few weeks and notice there have been no sales to St. Maarten when they post other sales. What gives?

A. Airlines post sales when they need to sell seats. We've kept meticulous records the last few years and there's a definite pattern to when they do this, though variations occur. Spirit has only been serving SXM for five or six weeks so they have no "pattern," but they have little capacity (flying three times a week on A319 aircraft). They will likely grow their frequency to daily late this year. More sales are likely then, particularly if they add more flights on Friday, Saturday, and Sunday. Members needn't dote on watching them since we do, and we always try to report all relevant sales as quickly as we can.

Q. How do round-trip air prices look for next winter?

A. We expected little airfare action in May because of spiking jet fuel prices. As members know, prices for travel now through next April came in way under what we expected, and we notified members several times in May about $300-range round trips from the Northeast, Southeast, Midwest, and Southwest. June may be slower; usually it is the second slowest month of the year for travel to SXM and many folks are preoccupied with other things in June. Nonetheless, we are watching fares from wholesalers, consolidators, charter operators, and the airlines themselves around the clock and will holler at once whenever we uncover significant changes. Fares for next winter have "dipped" to lower-than-usual numbers several times in the last few months, surprisingly. When you get an Airfare Bulletin, jump quickly if it shows fares you want; they are available but they sell quickly.

Q. If I can get some of these fares directly from the airline, why should I pay you?

A. We are on the phone and on the net searching for breaking fare news 24/7/365. Minor changes are virtually always posted immediately on our "secret site" Current Airfare Sales page, but major changes (reflecting hundreds of dollars off "traditional" fares) get noted both online and via an immediate Low Airfare Bulletin to all members.

Contrary to what you might think, airlines almost never ballyhoo the vast majority of their significant fare reductions; it's peculiar but true. And air travel websites won't tell you when fares to foreign countries (SXM) decline; only we do that. Yes you can get some of these fares from the airlines, but the trick is knowing precisely when they're available. Airlines communicate a tiny percentage of fare reductions. We communicate as many as we can get our hands on, and that is hundreds of them. You can't save on airfares unless you know when they've dropped, and that's where we come in. Unless you want to spend your life searching, the chances are small that you'll find these fares. It's why close to 4800 people have joined us since JMB Website Supporters began in 2002.

Q. I haven't seen many low fares from the west coast lately. Why?

A. We have many members in Southern California and the Pacific Northwest looking for low fares. During the last six to eight months, we've seen fewer low fares from that area than in the past. It hasn't gone on long enough to be a "trend" but it is annoying to us as well as to you, since we can't create fares --- only report them. We are actively searching for fares from throughout the US, Canada, and Western Europe and we have every reason to believe sale pricing will return to the West Coast and Pacific Northwest, particularly as competition heats up.

Q. What's up with Jet Blue?

A. Good question. We heard from three sources nearly a year ago that they were coming to SXM in "Winter 2007" but it never happened. In summer 2006, they pushed out / slowed some expansion plans and we suspect that's what they did with SXM. We still expect them to add routes to SXM, starting with JFK. It would not surprise us to see them also fly to SXM seasonally from BOS and CLT, but who knows? We've heard nothing for a year. The head of another big airline in SXM told us last winter, "They'd be fools not to come in here," and we totally agree.

Q. I've read all the complaints about US Airways. They are convenient for me. Should I really stop flying them?

A. If you like an airline and have confidence in them, stay where you are. US Airways (and American, and Delta) all have problems to overcome and they will. US Airways is keenly aware of its deteriorating service and its disappearing passenger base and it intends to solve its problems. American's pilots and other employees are livid over that airline's big payments to management, so they (despite much higher customer satisfaction than US Airways) are no more stable than US Airways. Delta has just limped out of bankruptcy and hasn't clearly shown what it wants to be when it grows up. Other airlines may simply be different, not "better" in terms of stability. On the other hand, we haven't flown US Airways in years; we fly mostly AA and Jet Blue.

2. Reconfirm Your Flight Reservations

US Airways, Continental, United Air Lines, American, and Delta all have made schedule changes in the last several weeks that have affected thousands of reservations.

If you have confirmed seats on future flights to SXM on any of these airlines, call your airline now to reconfirm and call again a couple of weeks before you're scheduled to fly. The airlines might have some schedule surprises for you and they (for whatever reason) don't seem highly motivated to call to tell you. Please call them.

3. AA Honchos Looking Like Something Other Than Geniuses

We're keeping an eye on news from pilots and other employees at American, who are not at all happy about big bonuses that airline is offering senior execs while giving pilots and others "bupkis." The pilots and employees agreed to hundreds of millions of dollars in wage and benefit concessions to avoid bankruptcy, and now this happens. Despite their unhappiness, they are performing professionally. Hopefully the airline will take care of them but if it doesn't, they certainly have the capacity to take care of business themselves.

We'll keep watching this.

4. SXM To Ready Port For Megaships Carrying 4500+ Passengers

The Wathey Cruise and Cargo Facility at Point Blanche is apparently going to get a multi-million-dollar upgrade to help it keep pace with the next class of superships which, we think, Royal Caribbean should rename from "Genesis" to "Humongoid Gargantua."

The current largest ship in the world, RC's Liberty of the Seas, was slated to visit SXM last Tuesday, but it is a rowboat compared to Genesis ships. Liberty, according to press reports, has a gross tonnage of 160,000 and can accommodate 3,630 cruise passengers and
a crew of 1,360.

Big deal. Cruise Critic notes, "Royal Caribbean has announced it will build cruising's biggest ship ever with the development of a 220,000-ton, 5,400-passenger ship. To be developed under the project name Genesis, the first ship is planned for delivery in fall of 2009."

With major port changes, SXM will be ready to accommodate the Humongoid Gargantua class of ships in 2009.

5. Hurricane Season Begins

It started last Friday and on Thursday, NOAA and the National Hurricane Center issued a "Special Weather Statement" about a system near the Yucatan that it felt had some potential for development. That storm turned into T. S. Barry, the remnants of which were soaking New England this morning.

6. Sea Palace Added To Timeshare Listings On Our Condorentals / Sales Page

Owners there rarely sell or rent out weeks and seem to be highly satisfied.

7. Big Sign At Pelican Adds Insult To Injury to C, D Building Owners

As if erecting a humongous monolith (the "Marina Residences") in front of the verandas of C and D building timeshare owners weren't bad enough, we hear now that Pelican Resort Club / Royal Resorts has plastered a three-story by 10-foot wide billboard on the side of the Marina building exhorting, "Want this View?"

The billboard then shows a picture of the Simpson Bay view that was available to all C & D building owners until Pelican/Royal decided to obliterate it by piling about 9 or 10 stories of "Marina Residences" there. Perhaps the sign should read, "For only $85,000, we'll give you back the view you thought you bought from us before."

And will they refund the original cost paid by timeshare owners of the C & D buildings? Sure, when the island has its first blizzard.

All of which forever redefines "bad taste," doesn't it?

11. Caravanserai Update

Although construction of the new units at Caravanserai Resort, Dutch Side, was approved months ago, we've seen nothing further about it. Some minimal site preparation was underway late last winter, but we've seen no news about when this long-delayed project will actually be done. Neither is there info about when the long-dormant Casino on the property (formerly Dolphin, which moved to Simpson Bay) will reopen.

As soon as we hear more we'll pass it along.

12. Sun Resorts, Mullet Bay Beach Resort Owner, Is Sold: Marina Development Likely

The good news: Orient Express' new development at the Northern end of Simpson Bay Lagoon may well become the best looking resort on the island. It includes a yacht club.

The bad news: The more yachts and megayachts that are stuffed into Simpson Bay Lagoon, the more demand there is for the Dutch Side drawbridge to open, snarling traffic.

Now, Sun Resorts, owner of Simpson Bay Yacht Club and the remains of the old Mullet Bay Beach Resort, has been sold and you'll be surprised to know that the buyer is an experienced developer of marinas.

IGY's plans for SXM are not known, but will likely involve further marina development either at Simpson Bay Yacht Club or Mullet Bay Beach Resort, or both. We'll keep you posted.

13. Turtle Pier Back on 'Recommended' List

Simpson Bay landmark Turtle Pier Restaurant, under a new management team for almost two years, ran into some administrative problems when it was converting from old to new management styles. The dining room staff was replaced and while changes were being made, service suffered.

The good news is that, according to members who have been to Turtle since February, things are now back to normal -- good service and delicious food.

That's welcome news since TP, still owned by Al and Rose Wathey, is a kick. Great full American breakfasts, lots of choices for lunch, and fine seafood and steaks for dinner and of course, their legendary lobsters from their own lobster pond in Simpson Bay Lagoon. (Don't forget their coconut shrimp.) We'll be expanding our coverage of them on everythingstmaarten.com soon... do check them out. They are next to Avis on Airport Road, Dutch Side.
